History of The Mansion at Ocean Edge

The Mansion at Ocean Edge is a member of the Historic Hotels of America and listed on the National Register of Historic Places. The Mansion resembles an English country manor with an eclectic blend of Renaissance Revival and Gothic themes. The Mansion houses Ocean Terrace, Bayzo’s Pub, The Roscommon Room, The La Salette Room, as well as wedding, meeting, and public spaces.

The current Mansion was built in 1912; however, its origins date years earlier to the original house on the site. Fieldstone Hall was built in 1890 by Samuel Mayo Nickerson, a prominent local figure with deep New England roots. Born in Chatham, Massachusetts in 1830, Nickerson is a descendant of Puritan settlers who landed on the Cape in the 1600s. Nickerson left school at the age of 17, and worked his way to Chicago where, by 1858, he had established a prosperous career as a distiller of alcohol and high wines. That same year, he married Matilda P. Crosby of Brewster, and the couple gave birth to their only child, Roland, the following year. In 1863, Samuel co-founded the First National Bank of Chicago. He became President four years later and held the position for nearly a quarter century before retiring as a multi-millionaire by 1891.

The pull of the Atlantic coast remained strong for Samuel, who returned frequently to the Cape throughout his career. As the story goes, one morning in the late 1880s he stood on a bluff in Brewster, jabbed his gold-tipped cane into the ground, and declared that a house should be built there for his son Roland, on a 48-acre parcel overlooking Cape Cod Bay. Fieldstone Hall was erected for Roland, his wife Addie, and their three children - Roland Jr., Samuel, and Helen.

Finished in 1890, the three-story home boasted four chimneys, and the property included a carriage house complete with a stone tower for taking in the expansive coastal views.

While never attaining the degree of success of his father, Roland became a very prominent person in the Town of Brewster. The estate, which was said to have been staffed by nearly two dozen servants, was the scene of frequent lavish parties thrown by the socially and politically prominent Nickerson's over the years. Guests included such luminaries as President Grover Cleveland.

The era of grandeur ended abruptly on the morning of May 10, 1906, when Fieldstone Hall inexplicably burned to the ground. A local newspaper account told that, as the house "…was licked up by flames, Hon. Roland C. Nickerson, sick from heartache, waved farewell and circled around the scene in his automobile to safety." In the wake of the devastating fire, some claim poor Roland drank himself to death. Along with the house, the fire also claimed the family's wardrobe, rare china, and a myriad of paintings and books. The financial loss was tallied at $500,000 more than was covered by the Nickerson's insurance policy. Undoubtedly agitated by the event, Roland succumbed to his poor health just two weeks later. Roland's wife Addie was devastated by her losses but determined. By 1907, she and Samuel began construction of a new residence on Fieldstone Hall's original foundation. Sensitive to his daughter-in-law's understandable fear of fire, Samuel built the house with steel reinforced concrete covered by stucco to be nearly conflagration-proof.

The new house was larger than Fieldstone Hall and included 16 rooms. All main bedrooms were outfitted with Italian marble fireplaces, individual bathrooms, and walk-in closets. Woodworkers were brought over from Italy to create the fine woodwork carving on stairs, ceilings, and interiors.

Today, the main entrance hall boasts an intricately carved oak staircase thanks to those Italian artisans, and the porte-cochere entrance (now the Mansion reception area) was a billiards room. Look at the ceiling and you'll notice the carved busts of Shakespearean characters with their eyes toward the billiard players. It has been said that the room also served as a roller-skating area for the Nickerson children and their friends.

Leaded glass windows and wide terraces overlooking the Bay added to the feeling of grandeur. The old carriage house was re-faced in stucco to match the new Mansion. Smaller rooms on the third floor housed the staff and an iron cage elevator was installed for ease of mobility between floors. The work was completed by 1912, the same year Samuel's wife, Matilda died, and just two years before Samuel passed away.

The Mansion remained in the Nickerson family until 1945, when it was sold to The Missionaries of La Salette, a Catholic Community of priests and brothers who utilized the land and mansion as a retreat house and seminary. The seminary was especially popular in the 1960s. The provincial priests and teachers lived and celebrated mass in The Mansion. Students lived and prayed in the renovated Carriage House, which housed a chapel and dormitory style accommodations. The were personal altars on The Mansion stairwell as well as another chapel against the front windows in the current La Salette Room. Corcoran Jennison purchased the property in 1980 and opened Ocean Edge Resort & Golf Club in 1986.

Today, the Mansion and Carriage House have been enhanced to benefit the historic character, including period furnishings and appropriate finishes to newly restored wood.

The Mansion Rooms: Then & Now

The Great Hall

Great Hall carries the same name that it did when the Nickerson’s resided on the property. This was the main entrance of the home and is where Addie did most of her entertaining. All the woodwork in the Great Hall is original, including doors, floors, fireplaces, and the staircase.

The Nickerson Room (The “Gun Room”)

What we now call the Nickerson Room was formerly the Gun Room for the Nickerson Estate. On the left wall of the room formerly housed the gun rack. Above the fireplace is the original Nickerson family crest, where it has been for over one hundred years. The window to the right of the fireplace was constructed using wine bottle bottoms, and is home to the Ocean Edge logo, a symbol, we think, of hospitality. An inscription in Old German, next to the jolly man hoisting a stein of beer roughly translates to, “when you are feeling down and low, a beer will improve your spirits”.

Lobby (the “Billiard Room”)

The current Front Desk lobby, with its original fireplace and bench seating, was formerly the billiard room. The bench in the room is raised to allow spectators a direct line of sight to the game being played. Notice the carved busts of Shakespearean characters mounted around the room with their eyes on what was once the billiards table.

The Roscommon Room (the “Dining Room”)

The Roscommon Room on the first floor of the Mansion was once the Nickerson family dining room. As an homage to its origin and the Irish legacy of our current owners, The Roscommon Room now serves as one of our restaurants. The fireplace is a showcase of the Italian craftsmanship and skill of woodworkers. The door that is visible, though no longer in use, lead to the butler’s pantry in which all of Mrs. Nickerson’s fine china and crystal was kept. The original shelving of the pantry is still in place but is currently used for Ocean Terrace Restaurant. From the pantry, one could directly enter the kitchen. Addie had a personal chef that not only cooked while at home but also traveled with the family.

Ocean Terrace (the “Back Porch”)

One of the reasons Samuel Nickerson selected this site was because of the spectacular view of the property and Cape Cod Bay. On a clear day, Truro and Provincetown can be seen from the terrace on the back of the house. When the Nickerson’s lived here, the back of the property was virtually treeless and behind the home was a farm, beach, golf course and skeet-shooting course. Roland and Addie’s love of the outdoors was obvious based upon the design of the back of the property. Her skeet-shooting course occupied what is now the Bay Pines tennis court. The 9th hole of the golf course ended at the water tower that still stands on the East side of the property; its location was designed to allow for socialization immediately following a round of golf. Also, in the back yard was the family farm, in which her many live-in servants tended to sheep, cows, pigs and chickens.

La Salette Room (the “Library”)

This room was formerly the Nickerson family library. The bookshelves are original, and many of the books were left behind by the La Salette Brothers who occupied the home from 1945 to 1981.

Bayzo’s Pub (the “Basement”)

The foundation was set by hand in the 1880s and consisted of fieldstone, brick, and mortar. The basement was originally used for storage of coal, wood, trunks, wine, and personal belongings. The 1906 fire began here. Ascend to the main floor via the wood railed staircase and note the hidden entrance at the top. Both the Nickerson’s and La Salette priests housed their safes behind this secret door. Today, this space serves at the resort’s only year-round restaurant, Bayzo’s Pub, a charming English style pub featuring pub classics, shareable plates, and live music.

Brewster Bayside Beaches

Known as The Brewster Tidal Flats’ which are the largest tidal flats in North America, Brewster’s beautiful beaches boast gentle surf, soft sand, warm water, and changes in appearance every few hours. A common complaint about New England beaches is the cold water. Being in an inlet and on the bay, Brewster is home to the Cape's warmest water, due to the dramatically changing shoreline that stretches nearly a mile into Cape Cod Bay during low tide. At low tide, the sun beats down on the sandbars. As the tide rolls in, the water quickly heats up over the warm sand providing us with nature’s very own radiant heating system.

The Brewster Flats

At low tide, Cape Cod Bay reveals what is known as the Brewster Flats, a display of smooth sand bars. These tidal flats are the largest tidal flats in North America. They are great for power walking (sturdy enough for baby joggers), beach games, and exploration, and oyster farms. Be sure to check out our guided Oyster Bed Tours available in the summer. Low tide is a wonderful time to relax and read, while kids get busy hunting for hermit crabs, minnows and other beach creatures found by the bucketful in the clean, warm water tide pools. At high tide, Brewster beaches change completely, boasting gentle surf and warm water, excellent for swimming, kayaking, and stand-up paddleboarding activities. Very gradual elevation changes make an easy water entry and exit for little ones. (Check out the mudflat exploration tours offered at low tide by naturalist guides from Cape Cod Museum of Natural History.)

Cape Cod National Seashore

The great “Outer Beach” of the Cape Cod National Seashore, on the ocean side of the lower Cape, was described in detail by Thoreau in the 1800's, and today is a protected beach within the national seashore. Forty miles of pristine sandy beach, marshes, ponds, and uplands support diverse species from Orleans and Chatham to Provincetown.

The Cape's Outer Beaches are worth checking out and are but a short drive or a half-day bike trip from The Mansion at Ocean Edge. The surf might be a bit higher, and the water is a bit colder, but the scenery is fantastic, offering glimpses of sand dunes, lighthouses, landscapes, and wild cranberry bogs. The National Seashore includes six swimming beaches, eleven self-guided nature trails, picnic areas and scenic overlooks. Some beaches (such as Marconi Beach) feature full bathhouses and changing areas.

Facial Treatments

Arrive Early: Please arrive 15 minutes before your appointment to change into a robe (remove upper-body clothing and jewelry) and complete a guest intake form. This helps your esthetician tailor the treatment to your needs.
What to Expect: Your facial will include a thorough cleansing to purify, nourish, and tone your skin. Makeup will be removed, and any contact lenses, plastic surgery, or injectables should be disclosed to your esthetician.
Relax and Enjoy: During your 50-minute facial, close your eyes and relax. Let go of the stresses of the day while your esthetician takes care of your skin. If you feel uncomfortable in any way—whether it’s pressure, temperature, or product sensitivity—please speak up. Your comfort is our priority.

The Mansion Fitness Center

The Mansion Fitness Center showcases Life Fitness equipment. We also have a multi-functional Icarian Trainer station to help with your tennis and golf swing. Free weight and stretching sections complement our fitness center, providing you with a variety of options for your workout. Towels and water station provided. The Mansion Fitness Center is on the first level of the Mansion West Wing, next to the Bayside Indoor Pool.

The Villages Cardio Room

For a cardio workout, the Villages Cardio Room located at the Fletcher Tennis Complex, is equipped with Precor equipment including treadmills and ellipticals. Televisions, a bench, and free weights are in the Cardio room as well. Towels and water station are provided.

Personal Training & Fitness Assessments

Allow our certified fitness professions to design a time-efficient program that will meet your needs both at Ocean Edge and at home. Choose from a variety of programs including Strength, Cardio, Yoga, Aqua, TRX, or Pilates Reformer in a private or semi-private setting. Rates start at $60 per ½ hour and $100 per hour for a private session. A three-session pass is available for $280. Personal training appointments require 24-hour notice to ensure trainer availability. Please specify type of training requested, any physical issues or requirements along with time, day, and room number on our Fitness Personal Training Extension 6300.

The Brewster Flats with their ever-changing landscape and poetic personification became Steven’s muse. After vacationing for years at Ocean Edge Resort & Golf Club, his family fell in love with the area and bought a home down the road. Golf Cart Policy

Golf carts are required for all resort guests.

Drivers must be at least 18 years old.

The Driving Range opens 30 minutes before the first tee time and closes one hour before sunset.

Tennis Courts

Ocean Edge features two exceptional tennis complexes staffed by USPTA certified tennis professionals. 5 Har-tru clay courts are located behind The Mansion at the Bay Pines Tennis Complex (Extension 6060). On the Villages side, 4 Plexi-pave courts are located at Fletcher Village (Extension 6065) at The Villages at Ocean Edge. Both tennis complexes house a Tennis Pro Shop. We recommend court reservations be made in advance. Court time can be reserved up to 72-hours in advance. The court fee is by time, not per person. Pickleball

Enjoy learning and playing this fun new sport on our six new pickleball courts, located at Blueberry Pond, adjacent to Britterige Village. Bike Rentals & Cape Cod Rail Trail

Ocean Edge Resort & Golf Club is fortunately located on the Cape Cod Bike & Rail Trail, a 26-mile spectacular journey that begins in Dennis, goes through Ocean Edge in Brewster, and extends all the way to the National Seashore. What better way to explore this local treasure than on Ocean Edge’s Freedom Flyer bike fleet. Rent one of our stylish bicycles at the Bay Pines Tennis Shop at The Mansion, or seasonally at the Blueberry Pond Recreation Center.

The Cape Cod Rail Trail follows a former railroad right-of-way for twenty-six miles through the towns of Dennis, Harwich, Brewster, Orleans, Eastham, and Wellfleet. Its paved surface, few hills, and well-marked automobile crossings make it ideal for cyclists. The trail has a wide unpaved shoulder on one side to accommodate walkers, and runners.

There are many opportunities to get off the trail and visit a beach. Food and water are also readily available and public restrooms can be found at Nickerson State Park, Salt Pond Visitors Center at the Cape Cod National Seashore, and the National Seashore Headquarters. For guests with disabilities, a limited number of hand-cycles are available for rent at local bike rental facilities. E-Bikes are available through the Brewster Rail Trail, located on Underpass Road.

Bike Rentals (In-Season)

Mansion guests may rent bikes on property by calling the Bay Pines Tennis Shop at extension 6060. The Villages guests can visit the Blueberry Pond Recreation Center behind the Member Sports Club, extension 6307. Adult bikes are $20 for two hours, $25 for up to four hours and $35 for a full day. Child bikes are $15 for two hours, $20 for up to four hours and $30 for a full day. Tag-A-Long toddler trailers are $15 per rental. Helmets and locks are available at no additional charge on a first come first serve basis. Take your pedal journey onto our private beach and the Brewster Flats with our new fat tire beach bikes. These bikes are available for rent from our Bay Pines Bike House adjacent to the Bay Pines Tennis Courts. An adult fat tire bike rental costs $35 for two hours or $60 for four hours. Fat tire bikes are only available in adult size.

Ocean Edge offers our own access to the Cape Cod Bike Trail from The Villages, directly across from Britterige Village.

Bay Pines Beach (Seasonal)

Our private Bay Pines Beach features a fleet of kayaks and stand-up paddleboards. Rentals last 45-minutes, include an additional 15-minutes for training. This activity is only available during high tide.

Blueberry Pond (Seasonal)

Britterige Village’s freshwater attraction offers daily kayak, tandem kayak, and stand-up paddleboard rentals. Choose a solo ride or grab a friend for a paddle in a tandem kayak. Now is your chance if you always wanted to try stand up paddle boarding. Our easy-to-use paddle boards are great for beginners, and there is no surf to worry about.

DOCK LOCATION:
When you enter the Britterige Village parking lot, you will see the Members Sports Club on your right. Walk down the paved pathway to the left of the Member Sports Club to meet the team at the Blueberry Pond Recreation Center.

General Rules & Frequently Asked Questions

Only Ocean Edge issued equipment is permitted on Blueberry Pond as outside rentals may introduce foreign algae or plant matter into the pond’s ecosystem. Food and beverage are not permitted in the boats, on the docks or on the pond, and must remain on the observation deck overlooking the dock.

The Great Outdoors

Just a three-minute bike ride from Ocean Edge is Nickerson State Park. A haven for campers, Nickerson State Park offers paddle board, kayak, canoe and sailfish rentals and a chance to swim in some of the Cape's most scenic ponds. The park features kettle ponds, which are remnants of glaciers and are so deep that they don’t freeze.

Addie’s is the Resort Boutique shop located in The Mansion offering branded apparel, local artisan goods, and resort essentials for all ages, open daily Memorial Day weekend to Columbus Day weekend.

The search for a perfect scone is over when you reach Hopkins House Bakery and Gift Shop. Here you will find fresh and delicious muffins, scones, cookies, pies, and desserts. The gift shop features antiques, primitive reproductions, folk art, Mary Beth Baxter art, and accessories for your cottage.

The Brewster General Store is as authentic and down to earth as its photos suggest. You might be tempted to stop roadside on 6A at the grocery store, but please make that stop at Ferretti's Market to stock up on items for your villa. Boar's Head meats, fresh breads and pies, and ready-to-grill items are all available at Ferretti's. While visiting Ocean Edge, hop on the bike path a mile down the road to see a Brewster Whitecaps baseball game. As part of the Cape Cod Baseball League, the Whitecaps have recruited some of the nation's best college level players. The Cape Cod Bike and Rail Trail is a 26-mile paved bikeway that runs from Yarmouth to Wellfleet. The terrain is mainly flat, with some minor grades at certain sections, specifically Orleans and Wellfleet. It offers the most variety in scenery and natural Cape landscapes and can be accessed from The Villages at Ocean Edge near Britterige Village. Underground Art Gallery – Visit Karen North Wells and this one-of-a-kind underground gallery located on Satucket Road, ½ mile from the historic Brewster Grist Mill and Herring Run. The gallery is an earth-covered structure built in 1988 to demonstrate environmentally-sound construction practices, as well as house Karen and Mac's production studios and exhibit spaces. The Cape Cod Museum of Natural History is housed in a 17,000-square foot building surrounded by 300 acres of town owned conservation land. The Beachcomber has been a must-visit destination for surfers, families, beachgoers, and music lovers for more than 50 years. Historic Sites in Brewster

Brewster Historical Society

The Brewster Historical Society, established in 1964, is a short drive from Ocean Edge and collects and preserves the artifacts and history of Brewster to ensure their future accessibility. Its main building houses four permanent galleries. Cobb House Museum, 739 Lower Rd. Brewster.

Stony Brook Grist Mill & Herring Run

The Grist Mill uses the falling water of Stony Brook to power its waterwheel. Inside, the miller grinds corn on the turning millstones. Visitors may purchase fresh cornmeal as a souvenir of their visit. Upstairs, the Museum features artifacts of Cape Cod life in the 1800's, and an antique loom used for weaving demonstrations. Photos and descriptive signs tell the story of Brewster's sea-faring history, the Herring Run and the industrial development of Factory Village. The Grist Mill is open the last Saturday in June and every Saturday from 10 AM – 2 PM through the end of August. Special events include an Indian Pudding Party in July and Cornbread Day in August. The herring run is a very exciting event, occurring in April and May when the herring swim upstream from the bay to Paine's Creek, then to Stony Brook Mill Pond. 830 Stony Brook Rd, Brewster. Windmill Village at Drummer Boy Park

Brewster’s Windmill, also known as Old Higgin’s Farm Windmill, was originally built in 1795 and located at Route 6A and Ellis Landing Road and then moved 100 yards toward Cape Cod Bay and away from the road on Ellis Landing because the sound of the sails frightened horses passing by. Around 1890 it was moved behind the Nickerson Mansion here at Ocean Edge. At some point, Mrs. Samuel Nickerson gave the mill to the Brewster’s Historical Society. She asked that the windmill be restored, preserved and open to the public. In December 1974, the windmill was transferred to its present site, 6 miles from its original location and completely restored.

Windmill Village and Museum are open from 12 PM – 3 PM Thursday, Friday and Saturday from June 29th through August 30th and Saturday 1 PM -4 PM from September 6th through October 11th. Heritage Museums & Gardens (Sandwich)

Situated in Sandwich, the Plantations are a complex of museums devoted to early American life. The art museum contains antique toys and the largest collection of Currier and Ives lithographs in the country. A 1912 carousel is a favorite with children. A replica of a Shaker roundhouse contains antique cars. Antique firearms and uniforms are on display in the Military Museum. Emergency Procedures

Please take a moment to read the following information and guidelines pertaining to fire-related emergencies. This resort complies with all federal, state, and local fire laws and regulations.

UPON CHECKING IN:

Please take a moment to locate fire exits near your accommodations. This information is available on the inside of your accommodation’s door as well.

Learn the layout of your room and how to unlock the door in the dark. Leave your room key close to where you sleep.
Locate the manual pull station alarm unit adjacent to your accommodations. If you find smoke or fire, sound the alarm by pulling the lever all the way down or dial “O” for the operator from your room telephone.
Fire extinguishers are in the common space adjacent to the units.
The sounding of an alarm indicates that a dangerous condition may exist within the building.

GENERAL MEETING LOCATION IS THE FRONT LAWN OF THE MANSION

If the fire is in your room, get out, close the door behind you and activate a manual pull station.
If the fire is not in your room, await further instructions. If directed to leave, feel your door. If it is cool, exit and proceed with caution to the nearest stairwell and exit.
If you are unable to leave your accommodation, make every effort to notify someone that you are in your room. If you cannot reach the hotel operator, call the local fire department, and identify your exact location. Signal to them by hanging a bed sheet from your window.
If your guestroom door is hot, do not open it. Your room may be the safest place to be. Call “O” (Operator) to report the fire and your location. Shut off the air-conditioning/heating unit in your room. Do not open or break your window. Fill your bathtub with water. Wet towels and stuff them around the door and vents to prevent smoke from entering the room. Wait to be rescued.
Do not jump from the room. A fall from any height can cause serious injury. Protect yourself from the fire/smoke and signal from your window for help.
Remember to crawl low when smoke conditions exist. Fresher air will be closer to floor level. Take your room key so you can return to your room if another exit is inaccessible.

General Laws of Massachusetts

Chapter 140: Section 10. Liability for loss of property Section 10.

An innholder shall not be liable for losses sustained by a guest except of wearing apparel, articles worn or carried on the person, personal baggage and money necessary for traveling expenses and personal use, nor shall such guest recover of an innholder more than three hundred dollars as damages for any such loss; but an innholder shall be liable in damages to an amount not exceeding one thousand dollars for the loss of money, jewels and ornaments of a guest specially deposited for safe keeping, or offered to be so deposited, with such innholder, person in charge at the office of the inn, or other agent of such innholder authorized to receive such deposit. This section shall not affect the innholder’s liability under any special contract for other property deposited with him for safe keeping after being fully informed of its nature and value, nor increase his liability in case of loss by fire or overwhelming force beyond that specified in the following section. Whenever an innholder provides a security box in the room of any guest, the innholder shall not be liable for the loss of any items deposited in the security box, by theft or otherwise, more than one thousand dollars; provided, however, that the provisions of section thirteen have been complied with. As used in this section, “security box” means a metal or alloy box used for the safekeeping of valuables or other property, which may be securely locked with a locking mechanism.

Chapter 140: Section 11. Fire or overwhelming force; liability

Section 11. In case of loss by fire or overwhelming force, innholder's shall be answerable to their guests only for ordinary and reasonable care in the custody of their baggage or other property.

Chapter 140: Section 12. Fraudulently procuring food, accommodations, or credit; removal of property covered by lien; evidence

Section 12. Whoever puts up at a hotel, motel, inn, lodging house or boarding house and, without having an express agreement for credit, procures food, entertainment or accommodation without paying therefore, and with intent to cheat or defraud the owner or keeper thereof; or, with such intent, obtains credit at a hotel, motel, inn, lodging house or boarding house for such food, entertainment or accommodation by means of any false show of baggage or effects brought thereto; or with such intent, removes or causes to be removed any baggage or effects from a hotel, motel, or inn while a lien exists thereon for the proper charges due from him for fare and board furnished therein, shall, if the value of food, entertainment or accommodation exceeds one hundred dollars, be punished by imprisonment in a jail or house of correction for not more than two years, or by a fine of not more than six hundred dollars, or if the value of the food, entertainment or accommodation does not exceed one hundred dollars, shall be punished by imprisonment for not more than one year or by a fine of not more than one thousand dollars; and whoever, without having an express agreement for credit, procures food or beverage from a common victualler without paying therefore and with intent to cheat or defraud shall be punished by a fine of not more than five hundred dollars or by imprisonment for not more than three months. The words “lodging house”, as used herein, shall mean a lodging house as defined in section twenty-two. Proof that such food, entertainment, accommodation or beverage, or credit for the same, was obtained by a false show of baggage or effects, or that such baggage or effects were removed from any such place by any person while such a lien existed thereon without an express agreement permitting such removal, or, if there was not an express agreement for credit, that payment for such food, entertainment, accommodation or beverage was refused upon demand, shall be presumptive evidence of the intent to cheat or defraud referred to herein.

Chapter 140: Section 13. Posting of statutory provisions

Section 13. Innholders shall post a printed copy of this and the three preceding sections in a conspicuous place in each room of their inns.

Innholder and Common Victuallers

Chapter 140: Section 12B. Removal of guest from hotel

Section 12B. An innkeeper may remove or cause to be removed from a hotel a guest or other person who: refuses or is unable to pay for accommodations or services; while on the premises of the hotel acts in an obviously intoxicated or disorderly manner, destroys or threatens to destroy hotel property, or causes or threatens to cause a disturbance; or violates a rule of the hotel that is clearly and conspicuously posted at or near the front desk and on the inside of the entrance door of every guest room. If the guest has paid in advance, the innkeeper shall tender to the guest any unused portion of the advanced payment at the time of removal.

Chapter 140: Section 12C. Refusal of accommodation in hotel to persons acting in disorderly manner; damage deposits

Section 12C. (a) An innkeeper may refuse to admit or refuse service or accommodation in the hotel to a person who: while on the premises of the hotel acts in an obviously intoxicated or disorderly manner, destroys or threatens to destroy hotel property, or causes or threatens to cause a public disturbance; or refuses or is unable to pay for the accommodations or services. An innkeeper may require the prospective guest to demonstrate an ability to pay. An innkeeper may require a parent or guardian of a minor to accept liability for the proper charges for the minor’s accommodation, board, room, or lodging; and any damages to the guest room or its furniture or furnishings caused by the minor and provide a credit card to cover the charges. When the parent or guardian cannot provide a credit card, the innkeeper may require the parent or guardian to make an advance cash deposit in an amount not exceeding $100 for payment of any additional charges by the minor or any damages to the guest room or its furnishings. The innkeeper shall refund the damage deposit to the extent it is not used to cover any reasonable charges or damages. (b) An innkeeper may limit the number of persons who may occupy a particular guest room in the hotel.

Chapter 140: Section 12D. Persons negligently or intentionally causing damage to hotel; liability

Section 12D. (a) A person who negligently or intentionally causes damage to the hotel or any furniture or furnishings within the hotel, shall be liable for damages sustained by the innkeeper, including the hotel’s loss of revenue resulting from the inability to rent or lease rooms while the damage is being repaired. (b) A person who negligently or intentionally causes injury to any other person or damage to any personal property of such other person on the hotel premises shall be liable for the injury or damage. (c) A parent or guardian of a minor shall be liable for acts of the minor described in subsections (a) and (b) if the parent or guardian provides a credit card or an advance cash deposit.
